Article 1 - Purpose

These Terms of Service govern access to and use of FigDraft, a private pre-CAD product handoff brief assistant currently in development. FigDraft is intended to help users organize rough non-confidential product notes, sketches, part names, intended behavior, and open questions before professional review.

By accessing FigDraft, requesting beta access, uploading materials, or using any FigDraft feature, you agree to these Terms.

Article 3 - Hosting

Hosting provider: Hostinger International Ltd

Server location: France, unless otherwise stated in the Privacy Policy or infrastructure documentation.

Article 4 - Service Description

FigDraft may provide some or all of the following features:

  • Upload or import rough non-confidential product sketches, scans, photos, or notes
  • Organize source material into draft visuals and reviewable handoff briefs
  • Add or edit part names, labels, intended behavior, and open questions
  • Generate AI-assisted prompts to clarify incomplete product inputs
  • Export or share beta materials in formats made available by the service
  • Store project files, source material, and generated beta output

FigDraft is an early product-preparation tool. It does not replace CAD, engineering, industrial design, prototyping, manufacturing, legal, safety, regulatory, or professional product-development review.

Article 5 - Beta Access

FigDraft may be offered as a private beta. Beta features may be incomplete, experimental, rate-limited, modified, paused, or discontinued at any time.

During beta, you should use non-confidential examples unless you have received written confirmation that the secure uploader and applicable confidentiality controls are active.

Article 6 - Registration and Accounts

To use certain features, you may need to create an account or request access.

  • You must provide accurate and up-to-date information
  • You must be at least 18 years old
  • You are responsible for protecting your login credentials
  • You are responsible for all activity under your account
  • You must notify us if you suspect unauthorized access

Article 7 - User Content and Product Materials

User Content includes sketches, photos, scans, part names, notes, files, generated briefs, project data, and any product-related material you submit to FigDraft.

  • You retain ownership of your User Content.
  • You grant FigDraft a limited license to host, process, transform, display, and export User Content only as needed to provide the service.
  • You are responsible for ensuring you have the rights and permissions needed to upload and process User Content.
  • You should not upload third-party confidential materials unless you have permission to do so.

Article 8 - Professional and Technical Disclaimer

FigDraft does not provide engineering, industrial design, manufacturing, safety, regulatory, legal, patent, or other professional advice. It does not confirm that a concept is feasible, safe, production-ready, or compliant.

You are solely responsible for:

  • Reviewing all output before relying on it
  • Working with qualified professionals where appropriate
  • Ensuring that any submitted or exported material is accurate and appropriate
  • Protecting sensitive product information before sharing it

FigDraft outputs are draft materials. They may require human correction, professional review, engineering work, or format changes before any downstream use.

Article 9 - AI and Output Accuracy

FigDraft may use AI-assisted or automated processes. These processes can make mistakes, omit details, misread inputs, create incorrect labels, or suggest unsuitable assumptions.

You must review, edit, and validate all generated outputs. FigDraft does not guarantee that any output is complete, accurate, technically feasible, safe, or suitable for production.

Article 10 - Plans, Pricing, and Payments

FigDraft may later offer feedback access, free previews, one-time validation packs, subscriptions, or other paid plans. Prices and included features are shown on the website or at checkout and may change over time.

  • Free previews may include feature, project, or export restrictions
  • Paid plans may include limits on projects, collaboration, or output formats
  • Payments may be processed by Stripe or another payment provider
  • Invoices may be sent by email after successful payment
  • Subscriptions, if offered, may renew automatically until cancelled

Unless otherwise stated, prices are displayed in USD. FigDraft is operated by a French sole trader. VAT is not applicable under Article 293 B of the French General Tax Code while the exemption applies.

Article 11 - Refunds and Withdrawal

If you are a consumer located in the European Union, you may have a 14-day right of withdrawal under applicable consumer law. However, where you request immediate access to a digital service or downloadable export, you may be asked to waive that withdrawal right for content already delivered.

Refund requests can be sent to patrick@figdraft.com. We may refuse refunds where files have already been generated, downloaded, or substantially consumed, unless applicable law requires otherwise.

Article 12 - Acceptable Use

You agree not to:

  • Use FigDraft for unlawful, harmful, or fraudulent purposes
  • Upload content that infringes third-party rights
  • Upload malicious files, malware, or harmful code
  • Attempt to reverse engineer, scrape, overload, or disrupt the service
  • Bypass rate limits, watermarks, payment, or access controls
  • Misrepresent FigDraft outputs as engineering, legal, safety, or regulatory advice
  • Use FigDraft to publish someone else's confidential product material

Article 13 - Intellectual Property

FigDraft, including its software, interface, brand, design, workflows, and documentation, is protected by intellectual property laws.

  • You receive a limited, personal, revocable right to use the service.
  • You may not copy, resell, sublicense, or exploit the service itself.
  • Your source sketches and generated handoff materials remain yours.
  • FigDraft may use aggregated, anonymized, non-identifying usage data to improve the product.

Article 14 - Privacy and Confidentiality

Processing of personal data is described in our Privacy Policy.

FigDraft is being designed for private product workflows, but beta users should not assume the same confidentiality level as a signed NDA or professional relationship. If your material is highly sensitive, do not upload it during beta.

Article 15 - Service Availability

FigDraft is provided on an "as available" basis. We may update, pause, limit, or discontinue parts of the service for maintenance, security, beta feedback, business reasons, or technical constraints.

We do not guarantee uninterrupted availability, permanent storage, or permanent access to beta projects.

Article 16 - Warranty Disclaimer

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or suitability for a particular product-development purpose.

Article 17 - Limitation of Liability

To the maximum extent permitted by law, FigDraft will not be liable for indirect, incidental, special, consequential, punitive, or business losses, including loss of profits, loss of data, failed product-development decisions, or disclosure decisions made by the user.

FigDraft's total liability for any claim will not exceed the amount you paid to FigDraft in the 12 months before the event giving rise to the claim, or USD 100, whichever is greater.

Article 18 - Indemnification

You agree to defend and hold harmless FigDraft and its publisher from claims, damages, liabilities, and expenses arising from:

  • Your User Content
  • Your use or misuse of the service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Your use of outputs in product, business, engineering, or legal workflows

Article 19 - Suspension and Termination

We may suspend or terminate access if you violate these Terms, create risk for the service, fail to pay applicable fees, or use the service abusively. You may stop using FigDraft at any time and request deletion of your account or project data where available.

Article 20 - Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted on the website. Material changes may be communicated by email or in-product notice where appropriate. Continued use of FigDraft means you accept the updated Terms.

Article 21 - Consumer Mediation for EU or French Customers

If you are a consumer located in France or the European Union and a dispute cannot be resolved directly, you may be entitled to contact a consumer mediator under applicable law.

Article 22 - Governing Law and Jurisdiction

These Terms are governed by French law, unless mandatory consumer protection rules in your country provide otherwise.

Subject to mandatory law, disputes will be submitted to the competent courts of Paris, France.
